These Terms of Use govern access to and use of CyberInsuranceApplication.com. By using this site, you agree to these terms.

1. Acceptance of These Terms

By accessing or using CyberInsuranceApplication.com (the “Site”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Site.

2. Who We Are

The Site is operated by Cyber Data Risk Managers LLC, an independent, licensed insurance brokerage specializing in cyber and technology-related risks (“we,” “us,” or “our”). We operate nationally within the United States.

3. Non-Binding Submission; Underwriting Required

Submission of information through the Site is non-binding and does not itself constitute a binder or the binding of coverage. Coverage is not bound unless and until confirmed in writing by an insurer, following underwriting review, approval, and satisfaction of any required conditions.

If an insurer elects to offer terms after underwriting review, quote options may be presented. Pricing, limits, terms, conditions, and availability are determined solely by insurers and may change based on underwriting guidelines and/or additional information requested during the process.

4. Application Guidance Scope

Any “Application Guidance” or on-site assistance is provided for informational purposes only to help users complete the application. It does not provide insurance advice, interpret coverage, recommend limits, or create an insurance contract.

5. Eligibility and Authorized Use

You agree to use the Site only for lawful purposes and only to submit accurate information on behalf of a business or organization for which you are authorized to act. You are responsible for maintaining the confidentiality of any application progress links or access features made available to you.

6. Information You Provide

You represent that information you submit is accurate and complete to the best of your knowledge. You agree to update information as reasonably necessary if circumstances change during the underwriting process.

Do not submit sensitive personal information unless the application specifically requests it.

7. Communications and Electronic Notices

By using the Site, you consent to receive communications from us electronically (for example, by email) regarding your application, requests, and related updates. You may opt out of non-essential communications where applicable, but doing so may affect our ability to provide updates regarding your request.

8. Privacy

Your use of the Site is also subject to our Privacy Policy. The Privacy Policy describes how information is collected, used, and shared in connection with the Site.

9. Intellectual Property

The Site and its content (including text, graphics, logos, and layout) are owned by us and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from the Site without prior written permission, except as permitted by law.

10. Prohibited Uses

  • Submitting false, misleading, or unauthorized information
  • Attempting to access non-public areas or systems without authorization
  • Interfering with Site operation, security, or availability
  • Introducing malware, bots, scraping tools, or automated submission mechanisms
  • Attempting to probe, scan, test, reverse engineer, or compromise the Site or its systems
  • Using the Site in a way that violates any applicable law or regulation

To the fullest extent permitted by law, all express and implied warranties are disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Cyber Data Risk Managers LLC and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) the Site.

14. Indemnification

You agree to indemnify and hold harmless Cyber Data Risk Managers LLC and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your submission of unauthorized or inaccurate information.

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when changes were made. Continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the state where Cyber Data Risk Managers LLC is domiciled, without regard to conflict of law principles. Venue for any dispute shall be in a court of competent jurisdiction in that state, unless otherwise required by applicable law.
